1. Respect for copyright
We respect intellectual-property rights and expect Users to do the same. The Service analyses publicly made statements by public figures in the public interest. It uses third-party materials (e.g. excerpts of statements) within the bounds of permitted use: the quotation right (Art. 29 of the Polish Copyright Act), the EU quotation exception (Directive 2001/29/EC) and the US fair use doctrine, for analysis, criticism, review, reporting and information. Quotations are attributed, kept to what is necessary, and linked to the original source.
2. How we handle source material (transcripts and audio)
2.1. To analyse a statement we may create an internal, machine-readable transcript of a publicly available recording (via captions or automatic speech recognition). This reproduction is made for the purposes of text and data mining (TDM) — see section 3.
2.2. We do not publish full transcripts or source audio. Transcripts and audio are internal working material. The published Service exposes only:
- a short quotation of the analysed statement (limited to what is necessary for the analysis), together with our verdict and commentary; and
- an embedded player / link to the original source (e.g. YouTube) cued to the relevant moment, so readers verify the quotation at the source.
2.3. Source audio is deleted as soon as a transcript has been produced. We keep transcripts only as long as needed for ongoing analysis and verification, and remove them on a valid request under section 5.
3. Text and data mining (TDM) basis
3.1. Reproductions of lawfully accessible materials made to carry out text and data mining rely on the TDM exception in Article 4 of Directive (EU) 2019/790 (DSM Directive), as implemented in Polish law (Act on Copyright and Related Rights, 2024 amendment).
3.2. This exception applies unless the rightsholder has expressly reserved that use in an appropriate manner (including machine-readable means for content made publicly available online). We respect such reservations — see section 5.
4. Rightsholder opt-out (reservation of TDM rights)
4.1. If you are a rightsholder and do not want your content used for TDM by Verdiktum, you may opt out by:
- a machine-readable reservation on your content or site (e.g.
robots.txt, metadata, TDM Reservation Protocol); or - a written notice to
contact@verdiktum.comidentifying the content.
4.2. On a valid opt-out we will stop mining the identified content and delete transcripts derived from it, save for short quotations that remain lawful under the quotation right / fair use in our published analyses.
5. Copyright complaint (notice) and takedown
If you believe material in the Service infringes your copyright, send a notice to contact@verdiktum.com including:
- identification of the work you hold rights to;
- the exact location (URL) in the Service;
- your contact details;
- a good-faith statement that you are authorised;
- your signature (electronic is sufficient).
This procedure meets the US DMCA (17 U.S.C. § 512) and the EU "notice & action" mechanism.
6. Our response
On a valid notice or opt-out we will, without undue delay, remove or disable access to the disputed material (and delete related transcripts) and notify the person who posted it (if applicable).
7. Counter-notice
If you believe material was removed in error (e.g. it is permitted use), you may file a counter-notice with: identification of the material, justification, contact details and signature. We will consider it and may restore the material.
8. Repeat infringers
Accounts of repeat infringers may be suspended or removed.
9. Public-domain materials
Some analysed sources (e.g. old historical texts) are in the public domain. Verdiktum's original analyses and compilations, however, are protected works.
