Methodology Kalshi obtained a license from the Commodities Futures Trading Commission (CFTC) in November 2020, registering as a designated contract market (DCM). Kalshi explicitly states that its Perpetuals are “CFTC-approved perpetual futures” and that it is the first company in the US to offer regulated perpetual futures to American traders. The CFTC itself asserts exclusive jurisdiction over these event contracts. However, this regulatory status is currently subject to legal challenges from several US states, which argue that some of Kalshi's contracts constitute illegal gambling under state laws. Additionally, the Chicago Mercantile Exchange (CME) recently filed a lawsuit against the CFTC, alleging that the agency wrongfully allowed Kalshi to list perpetual futures contracts in a way that circumvents established regulations. Despite these ongoing legal disputes regarding the scope and legitimacy of the CFTC's authority, Kalshi is indeed regulated by the CFTC.
